Hundreds of health care workers rallied outside the courthouse Friday to protest a former Tennessee nurse’s medication error that killed a patient, warning that criminalizing such errors will lead to more deaths in hospitals.

RaDonda Vaught was sentenced by a state judge after she apologized to Charlene Murphey’s family and said she would be forever haunted by her mistake.

After accidentally administering the wrong medication, Vaught was found guilty of criminally negligent homicide and gross neglect of an impaired adult in March.

Vaught will receive judicial diversion, which allows first-time offenders to have their charges dropped and their records expunged after successfully completing probation, according to Nashville Criminal Court Judge Jennifer Smith.

Although prosecutors were not opposed to probation, they argued against diversion. After hearing the sentence, the crowd of nurses outside cheered, cried, and hugged.

The relief came after the health-care workers sat in the sun for hours and clung to every word of the judge’s lengthy sentencing explanation for several minutes, some in a chain with their hands clasped together.
