The Louisiana law prohibiting same-sex marriage was declared unconstitutional by the court, which rendered it illegal. The decision resolved contradictory court decisions about whether or not state officials must provide licenses for same-sex unions.
Once the Fifth Circuit Court of Appeals reversed its decision in a Louisiana case, which the Fifth Circuit did on July 1, Governor Bobby Jindal stated on June 28 that Louisiana would comply with the ruling.
Jindal then declared that the state will defy the decision until the United States District Court for the Eastern District of Louisiana overturned it, which it did on July 2.
However, a state constitutional amendment that forbade same-sex unions and weddings was approved by voters on September 18, 2004, by a 78% to 22% margin. The legislation prohibited any other legal status that was “identical or substantially similar to that of marriage.”
