As far back as February 17th, 2007, paramedics were called on to attend to an emergency in Lucio’s residence. The issue was that her two-year-old Mariah was unresponsive and not breathing either.
Her County District Attorney’s Office said the two-year-old Mariah was found at the home with signs of abuse on her body and that her death on arrival at the hospital was attributed to her mother, and Lucio was convicted in 2008 over the issue.

An examination of the body of Lucio’s two-year-old daughter showed she had scattered bruising, bite marks on her back, patches of hair that indicated that it had been pulled out, and a broken arm.
Mariah’s autopsy report also showed a “head injury and bruising of the kidneys, lungs, and spinal cord”. Lucio had rejected the accusation of her daughter’s death indicating that the little girl had fallen down a set of stairs, which resulted in those injuries.
