Breyer wrote a letter to President Joe Biden announcing his resignation, which will take place after the court releases its final two opinions on Thursday at 10 a.m. Eastern time.
The White House indicated that Jackson will be sworn in at noon, immediately following Breyer’s retirement, with Breyer and Chief Justice John Roberts performing the two oaths Jackson must take in order to assume the bench.
