After the death of her two-year-old daughter, Mariah, who had widespread bruising in various stages of healing, as well as injuries to her skull and contusions of the kidneys, lungs, and spinal cord, she was found guilty of capital murder.
Prosecutors claim Mariah died as a result of physical abuse, but Lucio’s lawyers claim Mariah died because two days before her death, she fell down the stairs.

When Melissa Lucio was 16, her first five children were born to a father who drank regularly and physically abused her.
Mariah Alvarez was born in September 2004 to Melissa Lucio and Robert Alvarez. Lucio’s twelfth child was Mariah. Lucio had previously been investigated by Child Protective Services for charges of child neglect, and they found that Lucio’s younger children were frequently left in the care of their teenage siblings.
Lucio had a cocaine addiction, and she tested positive shortly after Mariah was born, resulting in her children being placed in foster care.
Lucio recovered custody of the other children in late 2006 after three older children went to live with their father in Houston.
