By the end of the 1980s, demand for Gallagher shows was so high that he “franchised” his act to brother Ron Gallagher, who began touring as “Gallagher II.”

However, promoters would occasionally “forget” to bill him as such, or as Ron Gallagher, and Ron frequently got into trouble offstage, resulting in negative press for his brother and the act.

Gallagher eventually took him to court, and after a protracted legal battle, Ron Gallagher was barred from performing as “Gallagher II” or using any of his brother’s material or props.

In November 1981, Gallagher has hired as a performer for the USS Enterprise (CVN-6520th )’s “birthday” celebration.

Gallagher first performed improv in hanger deck two for the crew on duty, using no props and consisting of him questioning crew members and responding comically to their answers. However, the crew proved to be too drunk and rowdy at the celebration, and he walked off the stage.

According to his former manager Craig Marquardo, the cause of Gallagher’s death was multiple organ failure.
